He was pulled over because his car matched the description of a car driving suspiciously, the car in question (which had a license plate number reported too) was apparently driving slowly and stopping in front of houses. When the officer came to the window and said this, he did not look at the officer and stated that he was driving normally.
He passed the one leg test, and the walk and turn test, but failed the eye pen test. Then Ian McGarvey pushed the breathalyzer wide right with a .087, not outrageously high, but above the legal limit, and especially above considering he is not 21. Which got me to thinking, why even waste his time with those tests? He passed 2/3, a 66% I believe, which I think is a D, which certainly isn't passing. If he passes those tests, maybe he shouldn't have to take a breathalyzer.
McGarvey was released on $3,500 bail at approximately 6:00 AM.
